Terms and Conditions

GPS-planet™

For the purposes of this Contract, a person who places an order with this store will be known as the "Customer" and/or "you". GPS-planet™ and our parent company, Suntelco LLC, will be known as the "Seller" and/or "we" and/or "us". The terms of this Contract become active when a Customer places an order with the Seller, pursuant to the laws of the Commonwealth of Pennsylvania. 

Returns Policy: No returns accepted for any reason beyond 30 days after the date the order was placed -- No Exceptions 

How do I return a product?  Go to our website, and at the top of the page, click on "Contact Us".  Let us know exactly why you want to return the product, and please be specific.  In addition, let us know if you want to replace the product because it's defective, or if you are just wanting to return for refund (minus shipping and restocking fees).   We don't do exchanges, so you would need to return the product first, and then make a new purchase of a different product. 

Store Credit:  We will waive our normal restocking fees if you request "Store Credit" for any returned products.   Actual shipping charges (including "Free Shipping" orders) will be deducted from the total.  The returned product must be in perfect resalable condition, under the terms and conditons as stated below.  You can use your Store Credit for future purchases and Store Credit does not expire.   Requesting store credit is the only way to avoid a restocking fee. 

Products returned in new condition, in their unopened, unmarred, manufacturer’s packaging, within 30 days of the order date will be charged a 5% restocking fee. If the manufacturer's box has been opened or the product has been turned on, a 10% restocking fee will be charged.  Additional deductions will be made for any missing, marred or damaged items. Returned products that are not in resalable condition will not be accepted for return (except if defective, see below) and will be refused and returned to the customer at customer's expense. Software products are NOT returnable unless defective (see "defective software" below). WE DO NOT DO EXCHANGES. Refurbished products are not returnable and not refundable.   ** The serial number on the product you return must match the serial number of the product we sold you, or there will be no refund or replacement.  Returning a product with a different serial number is fraud and we will only give you the option of paying $15 for return shipping of the product or we will dispose of the product within 30 days of receiving the product. 

Returned products must be received at the seller's warehouse within 30 days of the order date to qualify for refund or replacement. Items received after 30 days of ordering will be refused and returned to customer at customer's expense and no refund will be issued. All returns must have a valid RMA number written on the shipping label or package. Return shipments without a valid RMA number will be refused. Customer is responsible for return shipping charges to seller's warehouse. Customer is responsible for loss or damage to products being shipped for return, therefore we advise that insurance be purchased from the carrier. 

Defective products may be returned within 30 days of purchase for replacement with an identical product.  "Defective" is defined as a mechanical issue during the manufacturing process.  Defective does not mean you just don't like the product.  The customer is responsible for  shipping costs to send the defective product to us, and we will pay shipping costs for the replacement product.  If the customer decides to return the defective product for refund instead of replacement, we will refund the total, minus original shipping charges and 5% restocking fee.  WE DO NOT DO EXCHANGES

Order Cancels - Refused Shipments - Undeliverable Packages - We will issue a full refund for orders that have been cancelled before the order is has been sent to our our shipping department.  Once an order has been packaged and labeled, the order cannot be cancelled and the customer is responsible for all shipping charges.  Cancellation requests must be made by clicking on the Customer Service tab and clicking on Contact Us.  If the product has not already gone to the warehouse for shipping, we will refund the full order.  Orders are not cancelled until the customer receives an email confirming the cancellation.  Customers who refuse delivery or are unavailable to sign for the package, or after 3 unsuccessful delivery attempts, will be refunded, minus all shipping costs of the order.

Any defective product: The Seller must be notified of any defective product within 15 days of delivery for replacement with an identical item.   If the customer declines the replacement of the defective item and prefers to return it for refund, the order will be subject to the standard 10% restocking fee.  After 15 days of delivery, all defective product claims must be directed to the manufacturer or warranty provider for evaluation and support under the manufacturer's warranty and returns policy.  "Defective" means that there is a mechanical malfunction caused during the manufacturing process, it does not mean you just don't like the way the product operates.    Before requesting the return of a defective GPS, accessory or software, we recommend that you first contact the manufacturer (see contact information) to see if the problem can be remedied through technical support. If the manufacturer’s technical support staff cannot resolve the problem, then request an RMA# as outlined above. The defective return must include the manufacturer’s packaging and everything the manufacturer’s package originally contained. The customer pays the return shipping of the defective item and the Seller pays for Ground shipping of the replacement. We will test and confirm the defect and ship a replacement as quickly as possible, although this process can take up to 10 days to complete. If the product is deemed not defective by our technicians, it will be returned to the customer with a $15 return shipping charge. Defective products will be replaced with the same product and will not be exchanged for a different product. If the customer decides to return a defective product for a refund rather than receive a replacement product, the return will be subject to our 10% restocking fee.

Any defective Software: Due to the nature of software sales and copyright laws, defective software cannot be returned for anything other than replacement of the identical item purchased. We will replace defective software within 30 days from the shipment date. All defective software must be returned in its original packaging and must include the original box, manuals and accessories that came with it. Your software will be tested by a technician before a replacement is processed. Software that is returned as defective, which cannot be verified, or is damaged due to apparent misuse or neglect will incur a minimum 20% restocking fee or it will be sent back at the customer's expense and a replacement will not be processed.

Lost or Stolen packages: The customer understands and agrees that the Seller will not be liable for lost or stolen packages once the package has left our store. The Seller will assist the customer by filing a claim with the carrier (UPS, FedEx or USPS), but the final determination will be made by the carrier as to whether a credit or refund will be issued. Refunds or replacements will not be made by us until the carrier has approved the claim which can take up to 30 days. If the carrier denies the lost or stolen package claim, we will not issue any credit or refund. If a package is stolen, please contact us immediately through our Support System. Also, check to see if the package was left with a neighbor.

Excluded Items:  The following items have a NO RETURNS - NO REFUNDS policy and will not be accepted for return for any reason: ALL CoPilot software products, ALL software, ALL preprogrammed memory cards, ALL tracking devices (LandAirSea, SkyPatrol, Victoria, Spot Messenger, etc).

Damaged in Transit:   In the rare event that an item arrives damaged, please refuse shipment if damage is external or notify us within 48 hours if the damage is concealed. WE CAN NOT ACCEPT DAMAGE CLAIMS AFTER 48 HOURS from delivery date. The Seller, at it's sole discretion, will either ship a replacement or issue a full refund, but only when and if the claim is settled with the carrier.   We will not issue any refunds or credit to the customer if the carrier refuses the damage claim.

Payment Disputes / Frivolous Chargebacks / Non-Payment:   Non-payment of any funds owed to the Seller will be turned over to a collections agency to recover amounts unpaid, plus fees and interest.  By placing an order with the seller, the customer agrees to pay any and all court costs, legal fees and attorney fees incurred by the seller in the event of any legal action initiated by us, or by the customer, with litigation to take place in the courts of Pennsylvania.

We accept the following credit cards: Visa, MasterCard, American Express and Discover. We also accept payments using PayPal when shipping to a "verified address".  We will not accept or ship to "unverified" PayPal addresses.  PayPal payments are charged immediately.  We charge Pennsylvania customers, applicable Pennsylvania Tax. We only accept credit cards issued by U.S. banks with billing addresses in the U.S.. Transactions on gps-planet.com are 100% secure with 128-bit encrypted SSL technology.
 We reserve the right to cancel any order that has a Shipping Address that is not on file with the credit card issuer.  Due to rising credit card fraud, we take extra precautions to protect our customers from credit card theft

Shipping Information:
 
Although we do not guarantee when your order will actually ship, we try to get your order out as quickly as possible. Remember that UPS and FedEx do not count the day they pick up the package as one of the days in transit.  For example, if you place an order before 1 pm on Monday using FedEx 2 Day, the soonest you could expect your package would be on Wednesday. FedEx would count Tuesday as the first day and Wednesday as the second day. We offer the following shipping methods: FedEx Ground, FedEx Express Saver, FedEx 2 Day (2 Business Days) and FedEx Overnight (Next Business Day)

** An adult signature is required on on all deliveries by UPS or FedEx.  Instructions such as "leave package on porch" will be ignored.  The recipient must sign and accept the package.

Shipping to an address that is different from your Billing address will delay your order until we can verify the shipping address. The Billing phone number must match what is on file with your credit card company. This is for your protection as well as ours. The seller reserves the right to cancel any order that does not match what is on file with the customer's credit card company.

We can only ship to physical addresses - no P.O. boxes. We reserve the option to use other shipping companies, including FedEx and and USPS.  We cannot guarantee that any package will be shipped on time or that it will arrive on time.

** Some products may offer "Free Shipping".  Products returned for credit will be refunded, minus the actual shipping charges paid by us to ship the product to you.

** Hawaii and Alaska orders can ONLY be shipped by UPS 2nd Day Air.

International Orders
We are currently only shipping to destinations in the United States.

Backorders:

Seller will usually notify the customer by email within 24 hours if an item is out of stock.  If the customer doesn't want to wait, please cancel the order by submitting a support ticket - Contact Us.  If we do not hear from the customer before we ship the merchandise, we will assume that you have agreed to this shipment delay. We will ship the backordered item as soon as it arrives here.
If we are unable to ship the merchandise within 30 days or less, we will automatically cancel your order and you will receive a prompt refund.

Warranty:

After 30 days of the order date, products requiring Service, either Warranty or otherwise, should be returned directly to the appropriate Manufacturer. The seller does not do repairs.

Disclaimer and Liability:

By purchasing any product or device from the seller, the customer not only agrees to our Terms and Conditions, but also our Liability clause:

A GPS is just a tool and is not accurate 100% of the time. The driver still has to follow road signs and other safe driving habits and should never solely depend on a GPS unit.

The Customer agrees that the seller, also known as GPS-planet™, its owners, employees and representatives are not responsible for the proper use or installation of any product or device. The customer assumes all responsibility for the use and installation of all products and devices. The customer assumes all liability for any direct or indirect injuries or death and to damages to physical property in the use and installation of all products and devices purchased from the seller. The seller is not responsible in any form, directly or indirectly, for damages to people or personal property arising from the purchase of any products or devices from the seller. The sole responsibility for the proper use and installation of products and devices purchased from the seller, rests entirely on the customer who purchases those products or devices. The seller assumes no responsibility or liability for loss of wages or income or any other expenses due to any actions or products sold by us. The customer, his survivors, and assigns agree not to hold the seller responsible for any damages, and the customer agrees to pay for any and all court costs and legal fees resulting from any litigation or law suits filed against the seller or the seller's representatives, owners or employees.

The seller, its owners, employees and representatives are not responsible for manufacturer's claims or descriptions of products, nor the accuracy or suitability of any product.

It is the customer's responsibility to use products prudently. GPS units are intended to be used only as a navigational aid and must not be used for any purpose requiring precise measurement of direction, distance, location, or topography. Statistics provided such as trip time are best estimates and may not accurately reflect true conditions. The Global Positioning System (GPS) is operated by the United States Government, which is solely responsible for its accuracy and maintenance. The system is subject to changes which could affect the accuracy and performance of all GPS equipment. For use in vehicles, it is the sole responsibility of the customer and owner/operator of the GPS unit to place and secure the device so that it will not interfere with the vehicle operating controls and safety devices, obstruct the driver's view of driving conditions, or cause damage or personal injury in the event of an accident. Do not mount the GPS unit in a place where the driver or passengers are likely to impact it in an accident or collision. The mounting hardware supplied with the GPS unit is not warranted against collision damage or the consequences thereof. When used in vehicles, it is the sole responsibility of the driver of the vehicle to operate the vehicle in a safe manner, to maintain full surveillance of all driving conditions at all times, and not become distracted by the GPS system to the exclusion of safe driving practices. It is unsafe to operate the controls of the GPS system while you are driving. Failure by the driver of a vehicle, equipped with a GPS unit, to pay full attention to the operation of the vehicle and road conditions while the vehicle is in motion could result in an accident or collision with property damage and personal injury or death. The seller, GPS-planet,  and it's employees and owners are not responsible for any damages, or injuries, directly or indirectly caused by the use of a GPS unit. The customer or owner of the GPS unit assumes all risks associated with the use of a GPS unit.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, the SELLER, GPS-planet, AND OTHER SUPPLIERS DISCLAIM ALL OTHER WARRANTIES AND CONDITIONS, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

NOTICE TO DRIVERS IN CALIFORNIA AND MINNESOTA: State law prohibits drivers in California and Minnesota from using suction mounts on their windshields while operating motor vehicles. Other dashboard or friction mounting options should be used. GPS-planet does not take any responsibility for any fines, penalties, or damages that may be incurred as a result of disregarding this notice. (See California Vehicle Code Section 26708(a); Minnesota Statutes 2005, Section 169.71)
is not responsible for typographical errors. Incorrect prices because of a typographical error or wholesale price changes, will not be honored. Because the wholesale cost of electronics are constantly fluctuating, we may change our prices, policies and terms at any time.

This Contract is executed in Pennsylvania and the Customer agrees that any legal action or proceeding between the Seller and the Customer for any purpose concerning this Contract or the parties' obligations hereunder shall be brought exclusively in a court of competent jurisdiction sitting in Pennsylvania. In the event where legal action is necessary to enforce any part of this Contract, the prevailing party shall be entitled to attorney fees. This Contract constitutes the entire understanding between the seller and the Customer and can be amended only by a written instrument signed by both parties.
